Terms of Service

1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and Ikigai Technology (ABN [ABN]) ("we", "us"), the operator of The Lesson Plan, available at thelessonplan.com.au ("the Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility and account registration
You must be at least 18 years old and capable of entering a binding contract. The Service is designed for teachers and education professionals. You must provide accurate registration details and keep them up to date.
3. Your account responsibilities
You are responsible for keeping your password secure and for all activity under your account. Accounts are for a single named user. Tell us promptly if you believe your account has been accessed without authorisation.
4. Description of the Service
The Service uses artificial intelligence to help teachers draft lesson plans, lesson sequences, worksheets, booklets, slide decks and assessments referenced to publicly available NSW K–6 syllabus outcomes and content points. The Service is a drafting aid; it does not replace your professional judgement.
5. Free and paid subscriptions
The Free plan includes 5 AI generations per calendar month. The Pro Teacher plan includes up to 200 AI generations per calendar month, applied as a fair-use limit. Limits reset at the start of each calendar month and unused generations do not carry over.
6. Trials
Free trials are offered only where expressly advertised at the point of purchase. No trial is currently configured; if we introduce one, its length and terms will be shown before you subscribe.
7. Pricing and payment
Pro Teacher is charged at A$15/month or A$150/year in Australian dollars. Payments are processed by our payment processor (Stripe). We do not store your full card details. Taxes may be added where applicable.
8. Automatic renewal
Subscriptions renew automatically at the end of each billing period using your saved payment method, at the then-current price, until cancelled.
9. Cancellation
You may cancel at any time from Billing in your account, which opens the secure customer portal. Cancellation takes effect at the end of the current paid period. Your saved lessons and resources remain accessible; your account returns to the Free plan limits.
10. Refunds
[REFUND POLICY]. Nothing in these Terms limits rights you may have under the Australian Consumer Law.
11. Changes to pricing
We may change prices. We will give you reasonable notice before a change applies to your next renewal, and you may cancel before it takes effect.
12. Acceptable use
Your use of the Service is subject to our Acceptable Use & AI Use policy, which forms part of these Terms.
13. AI-generated content and your review responsibility
Content produced by the Service is generated by AI models and may contain errors, omissions or material that is unsuitable for a particular class or student. You are responsible for reviewing, adapting and approving all generated material before using it with students.
We do not warrant that generated material is error-free, factually accurate, curriculum compliant, or appropriate for every student or context. We describe outputs as curriculum-aligned, meaning they are drafted with reference to retrieved syllabus outcomes — not that alignment is guaranteed or certified.
14. Intellectual property
We own the Service, its software, design and branding. Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable licence to use the Service.
15. Your content and generated outputs
You retain ownership of the content you enter. As between you and us, you may use the lesson materials generated for your account for your own teaching purposes, including within your school. You grant us a licence to process your content solely to operate, secure and improve the Service.
16. Third-party curriculum material and trademarks
The Service references curriculum frameworks including NSW syllabus material. Those materials, together with associated trademarks, remain the property of their respective owners, including the NSW Education Standards Authority (NESA).
We are not affiliated with, endorsed by, sponsored by, or an official product of NESA or the NSW Government. A subscription does not transfer to you any ownership of, or licence to redistribute, third-party curriculum material. It covers access to the Service and the original resources it generates for you.
17. Third-party services
The Service relies on third-party providers for hosting, database and authentication services, payment processing (Stripe) and AI model inference. Their availability and terms may affect the Service.
18. Availability and changes to features
We aim to keep the Service available but do not guarantee uninterrupted access. We may add, change or remove features, and will avoid materially reducing paid functionality without notice where practical.
19. Suspension and termination
We may suspend or terminate your account if you breach these Terms, misuse the Service, or fail to pay. You may stop using the Service and request account deletion at any time.
20. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, including fitness for a particular purpose or accuracy of AI outputs.
21. Limitation of liability
To the maximum extent permitted by law, our total liability arising from the Service is limited to the amount you paid us in the 12 months before the relevant claim. We are not liable for indirect or consequential loss. Nothing limits liability that cannot be excluded under the Australian Consumer Law.
22. Indemnity
You agree to indemnify us against claims arising from your misuse of the Service, your breach of these Terms, or content you enter that infringes another party's rights.
23. Governing law
These Terms are governed by the laws of [GOVERNING JURISDICTION, e.g. New South Wales, Australia], and you submit to the non-exclusive jurisdiction of its courts.
24. Changes to these Terms
We may update these Terms. We will update the "last updated" date and, for material changes, notify account holders. Continued use after changes take effect constitutes acceptance.
